These terms and conditions ("Terms") govern your use of the website jmgmedia.co.uk (the "Site") and any products or services offered through it by Joe Gillett, trading as JMG Media ("we", "us", "our").
By using the Site, downloading a free resource, or purchasing a product, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About us
JMG Media is a sole trader business operated by Joe Gillett, based in England. You can contact us at info@jmgmedia.co.uk.
2. Use of the Site
You agree to use the Site lawfully and not to:
- Use the Site in any way that breaches any applicable law or regulation;
- Attempt to gain unauthorised access to any part of the Site or its systems;
- Introduce viruses, trojans or other malicious code;
- Use the Site to transmit unsolicited advertising or spam;
- Copy, scrape or extract content from the Site without our written permission.
We reserve the right to restrict or suspend access to the Site at any time without notice.
3. Free digital products
We offer free downloadable resources (e.g. guides, templates, checklists) in exchange for your name and email address. By opting in:
- You consent to receive the resource by email and to be added to our mailing list (you can unsubscribe at any time).
- The resource is provided for your personal, non-commercial use only.
- You may not redistribute, resell, or republish the resource without our prior written consent.
Free resources are provided "as is" without warranty. Whilst we take care to ensure our content is accurate and useful, we do not guarantee any particular results from using it.
4. Paid digital products
This section applies when you purchase a paid digital product (e.g. courses, templates, toolkits, ebooks) through the Site.
4.1 Pricing and payment
All prices are displayed in GBP (£). We are not currently VAT registered, so no VAT is charged. If our VAT status changes, prices will be updated accordingly. Payment is processed securely by Stripe. We do not store your card details.
4.2 Delivery
Digital products will be delivered electronically — typically by email or via a download link — immediately after payment or within a reasonable time. If you do not receive your product, please contact us at info@jmgmedia.co.uk.
4.3 Your cancellation rights (Consumer Contracts Regulations 2013)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, when you buy digital content that is not supplied on a tangible medium (e.g. a physical disc), you normally have a 14-day cooling-off period during which you can cancel your order for a full refund.
However, when you purchase a digital product from us, you will be asked to give your express consent for the digital content to be delivered immediately and to acknowledge that you will lose your right to cancel once the download or access has begun. This is in accordance with Regulation 37 of the Consumer Contracts Regulations 2013.
If you have not yet accessed or downloaded the product, you may request a cancellation and full refund within 14 days of purchase by emailing info@jmgmedia.co.uk.
4.4 Quality of digital content (Consumer Rights Act 2015)
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for a particular purpose, and as described. If a digital product you purchase is faulty or not as described, you may be entitled to a repair, replacement, or refund. Please contact us at info@jmgmedia.co.uk and we will work to resolve the issue.
4.5 Licence
When you purchase a digital product, you receive a personal, non-exclusive, non-transferable licence to use it for your own purposes. You may not resell, redistribute, share, or make the product available to others without our written permission.
5. Intellectual property
All content on this Site — including text, graphics, logos, images, videos, guides, templates and digital products — is owned by JMG Media or its licensors and is protected by copyright and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except as expressly permitted in these Terms.
6. Contact form
When you submit a message through our contact form, you agree that the information you provide is accurate and that you will not use the form to send spam, abusive content, or anything unlawful. 7. Third-party links
Our Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party site. Inclusion of a link does not imply endorsement.
8. Limitation of liability
To the fullest extent permitted by law:
- The Site and all content are provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses.
- We shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products.
- Our total liability to you for any claim arising from or related to a paid product shall not exceed the amount you paid for that product.
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under English law.
9. Indemnity
You agree to indemnify and hold JMG Media harmless from any claims, damages, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
10. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer.
